Allgemeine Geschäftsbedingungen (AGB)

  1. Geltungsbereich
    Diese Geschäftsbedingungen gelten für Verträge über die Teilnahme an Lehrgängen/Kursen sowie alle für Teilnehmer*innen erbrachten Leistungen der NSBacademy. Teilnehmer*innen im Sinne dieser Geschäftsbedingungen sind sowohl Verbraucher als auch Unternehmen bzw. Kaufleute gemäß BGB. 
  2. Datenerfassung
    Jede*r Teilnehmer*in erklärt sich mit der elektronischen Speicherung seiner/ihrer Daten gemäß Bundesdatenschutzgesetz zum Zwecke der Bearbeitung und Abrechnung des Vertrages einverstanden.
    Die NSBacademy sichert zu, dass sie nur zum ordnungsgemäßen Abarbeiten und dem Ausstellen von Zertifikaten persönliche Daten speichert, um die Anforderungen der DSGVO sicherzustellen. Nach spätestens 18 Monaten werden Daten gelöscht.

    Die Datenschutzerklärung muss präzise, transparent, in leicht zugänglicher Form und in einer klaren und einfachen Sprache sein, damit die betroffenen Personen nachvollziehen können, wie ihre Daten verarbeitet werden.

  3. Kursinhalte
    Sämtliche Kursinhalte sowie Ort und -zeit sind den jeweiligen Lehrgangsbeschreibungen zu entnehmen.
    Für Remote-Kursangebote werden die Zugangslinks rechtzeitig vor Beginn an die Teilnehmer*innen versandt. 

  4. Anmeldung
    Anmeldungen erfolgen ausschließlich in schriftlicher Form und werden nach der Reihenfolge ihres Eingangs bearbeitet. Mit der Anmeldung erkennt der/die Teilnehmer*in die allgemeinen Geschäftsbedingungen der NSBacademy an.

    Der Vertrag kommt durch schriftliche Bestätigung der Anmeldung des Teilnehmers/ der Teilnehmerin durch die NSBacademy zustande. Mit der Bestätigung erhält die Teilnehmer*innen gegebenenfalls weitere Informationen. Mit der Anmeldung bzw. in jedem Fall vor Kursantritt hat der Teilnehmer/ die Teilnehmerin ggfs. erforderlichen Unterlagen oder persönliche Details für den jeweiligen Kurs gemäß Kursbeschreibung in Kopie vorzulegen. Eine unvollständige Anmeldung berechtigt die NSBacademy vom Vertrag zurückzutreten und eine Bearbeitungspauschale in Höhe von 25 % der Lehrgangsgebühr einzufordern.

  5. Teilnahme
    Der Teilnehmer / die Teilnehmerin ist zur aktiven und engagierten Mitarbeit aufgerufen, um zum Erfolg des Lehrerlebnisses beitragen, das Gelernte besser zu verinnerlichen und die persönliche Entwicklung zu fördern. Konkret sind unsere Erwartungen:

    Engagement: Aktive Teilnehmer zeigen Interesse an den Lerninhalten und beteiligen sich aktiv an Diskussionen, Fragen und Antworten. Sie sind neugierig und möchten verstehen, wie das Gelernte auf ihre eigenen beruflichen oder persönlichen Ziele angewendet werden kann.

    Kommunikation: Wir erwarten dass die Teilnehmer*inne offen kommunizieren und Fragen stellen, um Unklarheiten zu klären. In Gruppendiskussionen beteiligen sich die Teilnehmer*innen, teilen ihre eigenen Perspektiven, hören anderen aktiv zu und können verschiedene Standpunkte konstruktiv diskutieren.

    Teilnahme an Aktivitäten: Aktive Teilnahme umfasst auch die Bereitschaft, an praktischen Übungen, Gruppenarbeiten oder anderen interaktiven Aktivitäten teilzunehmen, die dazu dienen, das Gelernte anzuwenden und zu vertiefen.

    Selbstgesteuertes Lernen: Aktive Teilnehmer nehmen die Verantwortung für ihren eigenen Lernprozess wahr. Sie setzen sich Ziele, überwachen ihren Fortschritt und reflektieren, ob sie ihre Ziele zu erreichen. Dabei ist die respektvolle Feedbackkultur ein Stützpfeiler.

    Analytische Denken: Die Teilnehmer*innen analysieren die präsentierten Informationen, bewerten deren Relevanz und Validität und ziehen Schlussfolgerungen aus dem Gelernten für das Tagesgeschäft sowohl an Bord als auch im Büro.

  6. Zahlung
    Das Entgelt für den jeweiligen Lehrgang ist innerhalb von 14 Tage nach Rechnungseingang fällig. Im Lehrgangsentgelt sind die zu erwerbenden Zertifikate, Lehrgangsmaterialien sowie eine Verpflegungspauschale enthalten. Bei Zahlungsverzug ist die NSBacademy berechtigt, Verzugszinsen gemäß den gesetzlichen Bestimmungen zu berechnen.

  7. Rücktritt / Abmeldung
    Der Rücktritt des Teilnehmers vom Vertrag ist vor Lehrgangsbeginn jederzeit möglich. Der Rücktritt muß schriftlich erklärt werden.

    Dabei gelten die folgenden Bestimmungen für die Entschädigungspauschale:

    Bis 15 Tage vor Lehrgangsbeginn ist der Rücktritt kostenfrei.

    14 bis 7 Tage vor Lehrgangsbeginn fällt eine Entschädigungspauschale in Höhe von 50% der Lehrgangsgebühr an.

    Innerhalb von 6 Tagen vor Lehrgangsbeginn fällt eine Entschädigungspauschale in Höhe von 100% der Lehrgangsgebühr an.

    In Absprache mit der NSBacademy ist jedoch die Benennung eines Ersatzes möglich. In diesem Fall entfällt die Entschädigungspauschale.

    Bei Vorliegen eines wichtigen Grundes ist die NSBacademy berechtigt, einen Lehrgang abzusagen, z.B. wenn der Instruktor erkrankt ist. In diesem Fall besteht keine Zahlungspflicht der Teilnehmer*innen bzw. werden eventuell bereits bezahlte Beträge erstattet oder es wird den Teilnehmer*innen ein Alternativtermin angeboten. Weitere Ansprüche des Teilnehmers / der Teilnehmerin gegenüber der NSBacademy bestehen nicht.

  8. Teilnahmebescheinugungen
    Die NSBacademy ist als Simulations- und maritimes Trainingszentrum durch den DNV gemäß den DNVGL-ST-0029 Standards zertifiziert.

  9. Haftung

    NSBacademy haftet für alle gesetzlichen und vertraglichen Ansprüche grundsätzlich nur bei vorsätzlichem oder grob fahrlässigem Verhalten. Bei Schäden, die auf der Verletzung essentieller Vertragspflichten beruhen, ist die Haftung auf den vorhersehbaren, vertragstypischen Schaden beschränkt. Eine Haftung für Folgeschäden oder sonstige Ansprüche auf Schadensersatz sind ausgeschlossen.

  10. Wirksamkeit

    Sollten einzelne Bestimmungen unwirksam sein oder werden, wird dadurch die Wirksamkeit der übrigen Bestimmungen nicht berührt. Im Übrigen gelten die gesetzlichen Bestimmungen.

  11. Gerichtsstand
    Ausschließlicher Gerichtsstand im kaufmännischen Verkehr ist Stade. Es gilt ausschließlich deutsches Recht.

General Terms and Conditions (GTC) (English Translation)

  1. Scope
    These terms and conditions apply to contracts for participation in courses and all services provided to participants by NSBacademy. Participants in the sense of these terms and conditions are both consumers and companies or merchants according to the BGB.
  2. Data collection
    Each participant agrees to the electronic storage of his/her data in accordance with the Federal Data Protection Act for the purpose of processing and billing the contract.
    The NSBacademy assures that it only stores personal data for the proper processing and issuing of certificates to ensure the requirements of the DSGVO. After 18 months at the latest, data will be deleted.
    The privacy statement must be precise, transparent, in an easily accessible form and in clear and simple language so that data subjects can understand how their data is processed.
  3. Course content
    All course content as well as location and time can be found in the respective course descriptions.
    For remote course offerings, access links will be sent to participants in a timely manner prior to the start.
  4. Registration
    Registrations are only accepted in written form and will be processed in the order in which they are received. With the registration, the participant accepts the general terms and conditions of the NSBacademy.
    The contract is concluded by written confirmation of the participant’s registration by the NSBacademy. With the confirmation, the participant* may receive further information. With the registration or in any case before the start of the course, the participant has to submit a copy of any required documents or personal details for the respective course according to the course description. An incomplete registration entitles NSBacademy to withdraw from the contract and to charge a processing fee of 25% of the course fee.
  5. Participation
    The participant / attendee is encouraged to actively and enthusiastically participate in order to contribute to the success of the teaching experience, to better internalize what is learned, and to promote personal development. Specifically, our expectations are:
    Engagement: active participants show interest in the learning content and actively participate in discussions, questions, and answers. They are curious and want to understand how what they have learned can be applied to their own professional or personal goals.
    Communication: We expect participants to communicate openly and ask questions to clarify ambiguities. In group discussions, participants* participate, share their own perspectives, actively listen to others, and are able to constructively discuss different points of view.
    Participation in activities: Active participation includes a willingness to participate in hands-on exercises, group work, or other interactive activities designed to apply and reinforce what has been learned.
    Self-directed learning: Active participants take responsibility for their own learning process. They set goals, monitor their progress, and reflect on whether they are achieving their goals. A respectful feedback culture is a pillar of this process.
    Analytical thinking: Participants analyze the information presented, evaluate its relevance and validity, and draw conclusions from what they have learned for day-to-day operations both on board and in the office.
  6. Payment
    The fee for the respective course is due within 14 days after receipt of invoice. The course fee includes the certificates to be acquired, course materials as well as a lump sum for meals. In the event of late payment, NSBacademy is entitled to charge interest on arrears in accordance with the statutory provisions.
  7. Withdrawal/cancellation
    The withdrawal of the participant from the contract is possible at any time before the start of the course. The withdrawal must be declared in writing.
    In this case, the following provisions apply to the compensation lump sum:

    – Up to 15 days before the start of the course, withdrawal is free of charge.
    – 14 to 7 days before the start of the course, a flat-rate compensation fee of 50% of the course fee will be charged.
    – Within 6 days before the start of the course, a compensation fee of 100% of the course fee will be charged.

    In consultation with NSBacademy, however, the naming of a substitute is possible. In this case, the compensation lump sum is not applicable.
    If there is an important reason, the NSBacademy is entitled to cancel a course, e.g. if the instructor is ill. In this case, the participants are not obliged to pay or any amounts already paid will be refunded or the participants will be offered an alternative date. The participant has no further claims against NSBacademy.

  8. Certificates of participation
    The NSBacademy is certified as a simulation and maritime training center by DNV according to DNVGL-ST-0029 standards.
  9. Liability
    NSBacademy is basically liable for all legal and contractual claims only in case of intentional or grossly negligent behavior. For damages based on the violation of essential contractual obligations, liability is limited to the foreseeable, contract-typical damage. Liability for consequential damages or other claims for damages are excluded.
  10. Effectiveness
    Should individual provisions be or become invalid, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply.
  11. Place of jurisdiction
    The exclusive place of jurisdiction for commercial transactions is Stade. German law shall apply exclusively.
